Welcome to Moxie’s Matches. These Terms of Use (“Terms”) are an agreement between you and THTM LLC. (“Moxie’s Matches,” “we,” “us,” or “our”), the operator of the Moxie’s Matches mobile app and the website at moxiesmatches.com (together, the “Service”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use Moxie’s Matches

You must be at least 18 years old and legally able to enter into this agreement to use the Service. Moxie’s Matches is intended for adults. By using the Service you confirm that you are 18 or older and that everything you tell us about yourself is true.

You may not use the Service if you have been convicted of a felony or any crime involving violence or a sexual offense, or if you are barred from using a service like ours under any applicable law.

2. Respect — how we treat each other

Moxie’s Matches only works when people treat each other with respect. By using the Service you agree to:

Be respectful and consensual. Treat other members the way you’d want to be treated. No harassment, threats, intimidation, hate speech, or discrimination based on race, ethnicity, religion, disability, gender, gender identity, sexual orientation, or any other protected characteristic.
Honor consent and boundaries. “No” means no. Do not pressure anyone, and do not share private conversations, photos, or anyone’s personal information without their permission.
Be honest. Use real, recent photos of yourself and accurate information. No impersonation, catfishing, or pretending to be someone you’re not.

You agree not to:

Upload or share content involving anyone under 18, or any non-consensual, unlawful, or sexually exploitative content.
Be abusive, predatory, or hateful — including misogynistic or “incel” behavior — or generally conduct yourself in a way that makes you someone the community doesn’t want to spend time with.
Use the Service for prostitution, trafficking, solicitation of money, scams, spam, or any illegal activity.
Promote or drive traffic to OnlyFans or similar paid-content platforms, or use the Service to recruit content collaborators. Being a creator is fine — this just isn’t the place to look for collabs or customers.
Harvest, scrape, copy, or store other members’ photos or information, or use the Service to contact people for any purpose other than genuine connection.
Upload viruses or malicious code, attempt to break, overload, or reverse- engineer the Service, or access it through unauthorized means.

We may remove content, suspend, or permanently remove anyone who breaks these rules, at our discretion, to keep the community safe.

3. Your content and your photos

You own the photos, text, and other content you add to your profile (“Your Content”). You are responsible for it.

By posting Your Content, you give us a limited license to host, store, resize, and display it only as needed to operate the Service for you — for example, showing your profile to other members so you can find connections. This license exists solely so the app can function and ends when you delete the content or your account, except for copies we are required to keep by law or that remain in routine backups for a limited time.

We use your images and information for one purpose: to help you find connections on Moxie’s Matches. We do not use them for advertising to others, we do not use them to train unrelated products, and we do not repurpose them for anything outside the Service.

4. Your privacy and your data

Your privacy matters to us. In plain terms:

We never sell your data. We do not and will not sell your personal information or your photos to anyone, for any reason. We believe your data belongs to you and no one else.
We never share your data with third parties for their own use. We do not hand your information to advertisers, data brokers, or other companies to use.
We use your data and images solely to provide the Service — to create your profile, show you potential matches, enable messaging, keep the community safe, and operate features you ask for. Nothing else.

The only limited exceptions, which are necessary for any app to run:

Service providers who operate the app on our behalf (for example, our cloud hosting and infrastructure provider) process data **only to provide those services to us**, under confidentiality obligations, and may not use it for their own purposes.
Legal and safety — we may disclose information if we are legally required to (such as a valid court order), or where we believe in good faith it is necessary to protect someone’s safety or to investigate a violation of these Terms.

5. Safety and your interactions with others

Moxie’s Matches helps people meet, but we do not conduct criminal background checks or verify the identity of every member. You are responsible for your own interactions and your own safety.

Use good judgment. Meet new people in public, tell a friend where you’re going, and never send money to someone you haven’t met.
We are not responsible for the conduct of any member, online or offline.
If someone makes you uncomfortable or violates these Terms, report them in the app or contact us.

6. Your account

You are responsible for keeping your login credentials secure and for everything that happens under your account. Let us know right away if you think your account has been compromised.

You can delete your account at any time from the app. We may suspend or terminate your account if you violate these Terms, if required by law, or to protect the Service or its members.

7. Moxie+ subscriptions and payments

Some features may be offered through a paid subscription (“Moxie+”). If you purchase a subscription, billing, renewals, and refunds are handled by the app store you purchased through (Google Play or the Apple App Store) under their terms. Subscriptions renew automatically until you cancel through that store. Prices and features may change; we’ll tell you before a change affects you.

8. The Service is provided “as is”

We work hard to provide a good experience, but the Service is provided “as is” and “as available,” without warranties of any kind. We do not guarantee that you will find a match, that the Service will always be available or error-free, or that other members are who they say they are.

9. Limitation of liability

To the fullest extent allowed by law, Moxie’s Matches and its operators will not be liable for any indirect, incidental, or consequential damages, or for the conduct of other members, arising out of your use of the Service. Nothing in these Terms limits any rights you have that cannot be limited by law.

10. Changes to these Terms

We may update these Terms as needed — for example, when we add features or to meet legal requirements. When we do, we will change the Effective date and Version at the top of this document so changes are easy to track. If a change is significant, we will give you reasonable notice (for example, an in-app notice or a message). By continuing to use the Service after an update takes effect, you agree to the updated Terms. If you do not agree, please stop using the Service and delete your account.

A record of the current effective date and version is always shown at the top of this page in the app and on moxiesmatches.com.

11. Governing law

These Terms are governed by the laws of [STATE / JURISDICTION — e.g. “the State of ___, USA”], without regard to its conflict-of-laws rules. Any disputes will be handled in the courts located in [JURISDICTION], unless applicable law requires otherwise.
